    Bake him a chocolate cake as a peace offering and use laxettes in both the cake and the icing - that should keep him occupied and unable to complain for at least a little while

    It must be that time of the year again.
    Just had the neighbour yelling at me over the fence again.
    This morning at about 10am i made 3x shelves for a metal storage cabinet i have.
    I made 3x cut's 900mm long and 3x cut's 450mm long, the wood was 7mm plywood and some 10mm thick mdf.
    Took under 10 minute's to mark it up and cut them out with a jigsaw.
    I fitted the shelf's and i had to tap the frame of the Brownbuilt cabinet to square it up so the door's would shut properly, it was a hard rubbish cabinet.
    Then the neighbour goes off at me.
    He yelled that i can't keep making noise right outside his lounge room, i said i was just squaring up a cabinet and told him it was never a problem when his lounge room was at the front of the house.
    He was fuming and talking over me, well yelling over me, and said he'll call the council and report me, i said that's ok, they told me it's ok to be doing what i'm doing.
    He replied no it's not and it's got to stop, you're making noise all the time !!
    I told him that i was lucky to make noise for half an hour over a full day between 9am and 5.30 pm, and i'd only make noise maybe 2 day's a week if that.
    BTW this happened at 4pm today.

    I have about 4 or 5 more shelves to make for another cupboard, then i can tidy up my back verandah and get everything neatly stored away
    So now i'm expecting the council inspector again, not sure if he'll be out this week as we are not supposed to be going out from this afternoon onward's with the Covid-19 virus happening, only to buy food etc

    Just show the council inspector your documentation here of what happened

    That neighbour is clearly on the wrong meds - that level of irascibility is clearly a mental health problem and it sounds like he's deteriorating

    Yeah it seem's like it is all building up inside his head,
    he doesn't seem to get over it, and goes off worse when something else happen's
    I just remembered he did yell at me again about 3 month's ago, i was cleaning my driveway with the pressure cleaner getting ready for our last inspection
    That took me about 20 to 25 min's to do from one end to the other, and it's an electric pressure cleaner

    ask his missus if she can put him into respite for a week or so .. be surprised if she doesnt jump at the surgestion .. just think if hes giving you trouble what she must put up with

    Time to put that phone camera to use then apply for an AVO, that will get his attention and stand a chance of modifying his behaviour - it's an awful strategy to have to deploy, but sometimes it's necessary

    Have the pressure washer fired up ready and start banging , welding , sawing and your heavy metal music turned up then when he starts bitching just 'accidently' aim the washer at him .... oops sorry neighbour
    I have an annoying barking little shitty yapping dog next door ... I only have to walk outside and he goes off for an hour after he rushes to the fence to take me out ... even after Ive gone back he keeps barking.... hose in the face over the fence shuts him up for days

    invest in a camera and film the interactions, or let him know in no uncertain terms that you are a Kenny Rogers fan and will be playing his music for at least a month mourning his death, maybe invite a bluegrass band to practice in your shed

    Aren't they the most useless annoying examples of the K9 breed. I used to have a similar one next door who would go off it's nut everytime I used the brushcutter. It wanted to have a go at me so bad it eventually got it's nose through between the palings, so I showed it what a 49cc brushcutter could do. Never a problem after that.

    The number of folk suffering quite serious mental illness in the community is staggering. Living next door to one that continually acts out can become a major stress factor, time waster and attention stealer. If you count up the amount of your time spent thinking, worrying, strategising about how unacceptable his behaviour is it would be astounding. This troubled guy possibly genuinely, albeit mistakenly , sees you as the cause of much of his personal pain, he is fixated and is probably currently hypersensitive to any sound emigrating from your property.. some councils employ professional mediators who can SOMETIMES resolve these types of issues.. as difficult as it is it’s really important to avoid yelling back, reacting emotionally or thumping him.. atm you are totally in the right,, if it ends up in court it’s very handy tp have a lily white history and his behaviour can be seen in all its awfulness as being totally unnecessary, extreme and unprovoked. Working for much of my career in a highly disadvantaged community I’ve seen this **** escalate into serious physical assaults, major property damage and home invasions.. my 2 cents worth is to be strategic, calm and use whatever experts are available to resolve it. You are entitled to conduct lawful activities in your own home free of harassment .

    Yeah i'm calm speaking back to him
    The last time he yelled at me for pressure cleaning the driveway, i heard him yell, turned around and looked at him for about 15 second's while still spraying the drive, then faced away from him and kept on cleaning the drive, think i made him madder by ignoring him?

    Sadly his wife is the same,
    a month ago on a saturday just after lunch i was spraying the tyre's of my car with tyre shine, cleaning and getting my XR ready for a coffee and chrome meet on the sunday morning
    His wife opened the side door of their house went up to the fence and loudly said What are you doing now?
    I replied I'm putting tyre shine on my tyre's, she walked away and slammed her side door shut.

    i feel sorry for you . except getting a security camera to doco everything not much you can do ,as you said they own their place so not going anywhere soon but should get some proof in case it builds up but do it discretly as it might set them off more

    I did a little reading up on Intervention Order's (AVO's) today,
    They mentioned that video footage may help if harassment keep's happening or if you have any other problem's from that person.
    But it say's if it's a private conversation between him and you, that you can't record it, the conversation become's public if any other neighbour's can hear him though, and the way i was yelled at the other day i am sure my other neighbour's would have heard him.
    Still not to sure if i will go ahead with it at this point as i think he may take thing's further if i do, and try taking me to court and i can't afford to do that



    The other night after the commotion happened. i saw my neighbour across the road talking to another neighbour who was mowing his lawn ( at 6.30pm)
    And i bet he wasn't having a go at him for making noise after 5.30, the other neighbour went back to mowing his lawn after they had finished talking.
    I might have to pay him a visit across the road and see if anything was mentioned about him yelling at me

    OK just to clarify - a private conversation is the audio only, AND there is an exclusion, if it's to protect your legal rights. - That falls under the listening device act curiously enough. Same goes for recording phone calls which is why you get the 'this call is being recorded for quality and training purposes' WHEN the telemarketers call you...

    Curiously taking a video of someone yelling at you over the fence is legal AS LONG as you are on your property and you don't have to be open about it.

    Don't lean over the fence however, if you need elevation, use a step ladder

    AVO applications are a several step process, if your complaint isn't legitimate in the first place, the police should tell you NO, having video will legitimise your complaint.

    From there negotiation will be encouraged and now you have some power, which is a good thing

    His side of the fence is higher, he stand's on a chair to see over the 2.3 metre tall fence when he's having a go at me.
    If i need to i can ask my cousin about the Intervention Order, he is a Police officer

    Definitely consult your cousin, in Victoria an IVO, their version of an AVO can be rendered unnecessary by an agreement between the parties to stop certain behaviour, which is basically what you want, to be left alone, nothing you are doing is a legitimate problem

    Be careful what you write here, too, as it is public. For instance, mentioning that you wish to use the pressure washer when you know it has been an issue and want to set up video recording sounds a bit like inciting a response, almost entrapment. I would let them know in advance that you intend to clean the driveway at a particular time and day. But definitely seek some advice from professional people, even give Legal Aid a call.
