Tricky insurance question- my mate went down

    Gday fellas

    Just wondering if anyone knows much about insurance- mate of mine came off yesterday, a cab did an illegal u turn in front of him. Bike is a bit of a mess, he's ok.

    Clearly the Cabbies fault (low speed, crossed a solid line, turned in front of him) but the trick is my mate is unlicenced- suspended for 3 months.

    So, coppers not involved, the cabbie is to contact his insurance. But the question is- can the cabbie's insurance find out if he is unlicenced (without asking my mate) and is this likely to end up being my mates fault for driving unlicenced?

    Heh I saw the same thing happen recently.

    Family member (really bad driver) hit another guy, and had to pay him. The other guy he hit didn't even have a valid license

    Not sure if this is the case 100% of the time but thats how I saw it unfold.

    For future reference I REALLY reccmend you make sure your mate gets a license before he decides to ride again.

    No it's not the cabbies fault, it's his fault.

    He shouldn't be on the road AT ALL. If he wasn't on the road, the accident wouldn't have happened. Simple.

    The insurance company won't do anything except get him to pay for everything. The insurance company isn't gonig to do anything. Your mate will have to pay everything out of his own pocket, however much damage there is to the car, road + abulance etc (too many variables).

    So yea, they'll look him up as well and report him.

    Insurance companies = loads of money = loads of money = loads of power = people with money don't like being stuffed around

    He'll also have another day in court.

    So things aren't looking pretty good at this stage.

    Personally I don't think that the cabbie should be forced to pay anything because he is technically unlicensed and shoudl not be riding a motorbike. Whether the law agrees I don't know. And yes, I would expect the insurance company to be able to find that information out (but perhaps not...)

    However... the law can be very funny and I wish your mate the best, though I don't agree with his decision to ride (he obviously lost his license for a reason... )

    You'd be surprised as to what insurance companies can get hold of.

    The cabbie doesn't have to pay squat.

    Yes, the laws agree with you Boz.

    just an update it is not likely the insurance will come through, however he is in contact with solicitors who advise him to sue him civilly. He is giving the cabbie a chance to pay up for the damage to the bike alone first.

    There have been a few people both of us have been in contact with- similar situation and won. Apparently comes down to the fact the cab caused the acco

    one bloke was even drunk at the time, unlicenced and successfully sued a driver, because the driver was ultimately the one that did something to cause the crash

    This situation sounds similar to the guy in the UK who broke into a ladies garage but let the door close behind him or something, locking himself in and nearly starving to death cause she was away on holiday... then sued her for the traumatic experience or something.

    Or the burglar who fell over a skateboard in someones hall, and sued the family for the injury.

    Id be really interested to know if he wins the case, it would seem that lawers are taking over the world...
