NSW For sale - 2001 Kawasaki ZZR 250

    2001 Kawasaki zzr 250

    My little bike has just became a project bike, as it has been hit by a car
    (Driver wont pay for damage)

    It has rego until January 2017
    Still ridable

    Fairings are damaged
    Instrument cluster not working
    Right fork and caliper both leaking
    Top end of the motor need work
    Engine was fully rebuilt at 64,750 k
    Has done 34,270 since.

    Asking $1000

    that's very sad, if the driver is refusing to pay, Im sure you could have a chat with your local policeman and get them involved. If they are at fault, then they need to make good.

    Hi Chris,
    It is sad. I have spoken to the person who hit my bike, he reckons that he done no damage to it and refused to pay for the damages, so i went to the police an got told that they wont get involved.

    So am not happy, as i cant afford to fix the damage so i have to part with it.

    It is a shame. A big lesson learnt, not to park a bike in the main street of newcastle anymore. My bike was only there for 10 minutes before it was hit


    it has put a damper on my big ride in November

    Do some research on this - there will be a way that you can take legal action against the driver without involving lawyers.

    There are legal options for small disputes. Find out what option there is in NSW.

    Get a summons and serve it on the driver. That might change things a bit.

    I did this last year with someone who kicked in a door on a car of mine. He mouthed off and called me all sorts of names, but he also knew that it was going to exist on his credit record for 5 or 6 years. That means that no-one will lend him money (eg banks).

    He ended up paying me via bank transfer with his phone.

    Also, go and talk to some bike shops. You'll need a quote for the repairs.

    Yea I would definately take it further

    Take photos of the damage , write out a description of what happened with dates and times, take the bike for a quote on repairs

    Would help if you have the drivers name and car description and rego ...... put it all into your 'report' and quote what the driver actually said to you.

    If you have all this on paper you could then tell the driver in writing that u are prepared to take it further if he doesnt compensate you.

    You should go to the police and report it. They have to give you a police report, by law. I think there are some places you can get free legal advice too. If you have insurance get them onto him, they're supposed to hold the at fault party accountable. Go talk to a lawyer with all your photos an information and take him to court, seeking damages plus court costs. Some of them have "no win no fee" sorta things, and first consultation should be free I'd think. Hold the mongrel accountable.

    Police wont get involved in minor accidents in NSW ..... and its just damage to property which would be a civil matter in this case in my opinion

    I don't think they'll get involved to resolve but they need to give you a report number. Most insurance companies want it anyway.

    Contact the police with the details because it's against the law to refuse to exchange details, that's an offence right there. Be insistent and firm with the police as they'll try to fob you off. They do have access to peoples details right there at the station, including the registered owners phone numbers in a lot of cases, also you are legally entitled to request that phone number.
    They may opt to contact the owner on your behalf.
    When contacting the you are entitled to their insurance policy details.
    That should be sufficient pressure to get things moving, then just contact the insurance company directly.

    Nope.....changed a couple of years ago

    I had a truck back into my drivers door of my car while it was parked ..... all fixed by insurance .... all I needed was the persons details .... no police involved

    Thanks for all the advice.

    I spoke to this twit on a few occasions
    And he believes that he has not done any serious damage to the bike an was very rude when i told him otherwise with a quote from my bike shop whom know my bike well.

    So i have decided to part with my bike and not deal with that moron ever again

    please send the moron a letter of demand with quote to fix.panel beaters have a standard form on file.find out his insurance company and send them a copy. if all else fails a solicitors letter works wonders.

    Yes he has got away with it. Hopefully karma will get him. He should not park near motorbikes
