My brother came off second best on Friday afternoon after a car pulled out of a carpark into his side as he was riding past. After spending most of Saturday in hospital he was released with multiple fractures in his left foot and ankle and a lot of road rash on his knees, arms and shoulders as he wasn't wearing a jacket at the time. The little Hyosung looks repairable but as we all know they aren't worth much so can be written off fairly easily as the repair cost builds up. A quick look this morning shows the following: - Lost both mirrors - Lost front right indicator - Front fairing cracked - Bracket under front fairing bent - Scrapes on fairings and exhaust down right side - Left foot peg and shifter bracket has been bent into the swingarm (this was the impact point) Remember kids... even if you're just going down the road to the shop make sure you've got all your gear on!
He's a bit sore at the moment but will recover. He may require surgery on his ankle but at this point they just want to wait a week and see how it's healing. No fines have been issued yet. There were two cops that attended the scene and it sounds like one of them was insinuating he deserved it for riding a bike and was probably doing something stupid that contributed to the accident. Thankfully there were quite a few witnesses. The other driver was a young female in a small blue hatchback who didn't stop at the scene. A cyclist chased after her and managed to get her to come back. Still not entirely sure what happened as his memory of the accident is a bit vague. It looks like she has pulled out without looking and managed to tap him hard enough that he overbalanced and hasn't been able to recover. Thankfully he was just coming around a corner so wasn't going very fast at the time.
bad luck, hope the driver's insurance takes care of it and your brother gets back on the horse soon if you were looking to fix it, i'm pretty sure you can get mirrors and foot pegs and bits like that for the hyosung's for not too much money.
Found out this morning the bike is a write off. Bent frame, forks, and swingarm. Probably not even worth buying back and fixing. Unfortunately for him he financed the bike and now owes more in finance than he's getting back from insurance. He's not going to be back on a bike anytime soon. He's got a follow up appointment with the orthopaedic surgeon tomorrow to find out if they need to operate on his ankle. Hopefully it's all healing well and he won't have to get anything done.
Thats bad news on the bike front but at least he is ok. The gall of the girl to drive off! Hope he has a swift recovery
i believe the car that hit him needs a letter of demand served on the driver for their insurance to pay for equivilant replacement.
unfortunately all the driver or their insurance company is liable for is the pre accident value (PAV) of the vehicle and if any gear was damaged that as well but depreciation can be added to clothing and safety gear. if there is any negative equity on the vehicle that is a subsequential loss that is not the responsibility of the at fault party.
Pretty much what Moo said. Because the driver of the car was at fault at least he doesn't have to pay the excess. It was insured for an agreed value and he did have optional cover for his gear so he'll get that back as well.
